About the role: 

Stability AI’s small legal team is growing quickly, and we are seeking a dynamic and experienced Associate General Counsel for Product & Privacy to join our legal team. As the Associate General Counsel for Product & Privacy, you will serve as the primary legal contact for the product, design, and engineering organizations, and you will play a critical role in ensuring the legal compliance and risk management of our products and services. The role will require the candidate to be ready to scale and lead a global product counseling & privacy legal function upon joining our team, including hiring and managing direct reports consistent with company growth.  You will have the opportunity to shape business and legal strategy in an industry with little legal precedents, brand new legal questions and concerns, and quickly evolving business models. While a technical background is not a requirement for the role, curiosity, the willingness to learn about new technologies, and the ability to translate an engineer’s technical explanations into actionable legal mitigation measures and contractual provisions is a must.

This is a remote role. Though we are a global company with headquarters in London, preference for location is Pacific time zone.

Responsibilities:

  • Manage the legal team’s product counseling and privacy function with minimal oversight
  • Gain an in-depth understanding of Stability’s products and development processes, including their strengths, limitations, and vulnerabilities from a legal, security, and ethical standpoint
  • Provide expert legal advice and guidance to product, design, and engineering teams to ensure Stability’s products and development processes comply with all laws, industry standards, and its own ethical guidelines
  • Work with product managers, engineering, release management, and security teams to create a set of policies, processes, and documentation governing all data and product releases to ensure thorough legal review
  • Ensure compliance with global privacy and data security laws
  • Track and provide guidance on global laws regulating AI products and services, and collaborate with the products team in implementing ethical and safety initiatives for our AI products/services
  • Provide guidance on various open source, commercial, and hybrid licenses that best achieve the open development or monetization objectives of our various AI foundational model releases and our other products, services, and research efforts
  • Provide guidance on copyright issues, including as they apply to the development and licensing of datasets used to train our AI models, the output of our generative AI products and services, and the hosting of content (such as the DMCA and Article 17).
  • Ensure tight integration with IP team and/or outside IP counselors to ensure protection of company IP and to help implement patent, trademark, and copyright strategies
  • Ensure compliance with global trade regulations, including US export control laws and the Trade Agreements Act
  • Provide frontline assistance to the commercial team in understanding Stability’s technology, licensing frameworks, and IP strategy on an ongoing basis
  • Assist the commercial legal team in template creation and negotiations as needed
  • Draft and review contracts, terms of use, privacy policies, DPAs, inbound technology agreements, integration agreements, joint marketing agreements, copyright licenses, technical partnership agreements, and other technology-related agreements to meet Stability’s strategic goals and ensure legal compliance and risk mitigation
  • Advise on marketing and disclosure matters, including the review of marketing publications, websites, and marketing collateral
  • Coordinate with and provide assistance to the Public Policy and Communications teams
  • Provide training and legal education to internal stakeholders on relevant legal topics
  • Conduct legal research and stay up-to-date with industry trends, regulatory changes, legal precedents, and emerging technologies that may impact Stability AI’s products
  • As company grows, hire and manage a team of direct reports, including creating annual budgets, developing hiring plans, and providing performance feedback and individualized growth plans for team members

Qualifications:

  • Juris Doctor (JD) degree from an accredited law school and active bar membership in good standing
  • 12+ years of experience as an attorney, with a focus on technology product counseling, privacy, and intellectual property
  • Previous in-house, leadership role as a product counselor at a technology company
  • Experience interviewing and evaluating candidates for legal roles
  • Ability to address problems creatively
  • Practical approach to commercially reasonable risk mitigation in the face of both legal and business uncertainty
  • Strong understanding of data privacy laws (e.g., GDPR, CCPA), intellectual property law (especially copyright law), and technology licensing
  • Experience with open source software licensing, data licensing, or source-available licensing, as well as open source development and open source communities
  • Proven track record of drafting policies, terms of service, and technology agreements
  • Deep understanding of emerging technologies, including AI and data analytics, as well as knowledge of the emerging regulatory and copyright developments affecting them
  • Excellent analytical, communication, and problem-solving skills, with the ability to distill complex legal concepts into clear and actionable guidance for non-legal stakeholders
  • Ability to work independently and collaboratively in a fast-paced, dynamic environment
  • Experience working with cross-functional teams and effectively managing multiple priorities
  • Proactive mindset to identify and address legal risks
  • High level of integrity, professionalism, and attention to detail
  • Flexibility to adapt to evolving priorities
  • Ability to foster relationships and collaborate with internal clients

Preferred Qualifications:

  • A technical background
  • Privacy and data security certifications (CIPP/US, CIPP/E)
  • Deep understanding of open source software development, open source licensing, and open source communities
  • Experience with music licensing (PROs, publishers, and labels)
  • Experience advising, managing, or conducting any content moderation, or handling DMCA or Article 17 matters
  • Experience doing deals with universities or other research institutions
  • Experience as part of a Commercial legal team
  • Excellent repertoire of English colloquialisms or appreciation for British humor (Stability AI is headquartered in London)
