Overview

Pharmaceutical Research and Manufacturers of America (PhRMA) is seeking a Deputy Vice President for the Law team to support its litigation-related efforts. This position focuses on the development of litigation strategy to advance the PhRMA Board’s key advocacy priorities and assists with managing PhRMA’s litigation docket and amicus curiae program. This position reports to the Vice President, Litigation and Antitrust.

The Deputy Vice President will:

  • Lead the development of litigation opportunities and strategy through coordination with PhRMA law leadership, member company lawyers, outside counsel, external stakeholders, and across PhRMA.
  • Oversee the groundwork, planning, strategic direction, and appropriate coordination of PhRMA litigation and relevant member company, industry, or other third-party stakeholder litigation in federal and state courts.
  • Coordinate with colleagues within the PhRMA Law Department and across PhRMA to maintain awareness of PhRMA’s broad engagement with Congress on PhRMA priorities and key federal agencies, e.g., HHS, CMS, HRSA, FDA, and USPTO, with respect to proposed agency action whether via notice and comment rulemaking, request for information, regulatory guidance, or otherwise.
  • Assist with managing PhRMA’s affirmative and defensive litigation, including review and preparation of pleadings, coordinating member company and internal subject matter expert input and participation, and engaging with outside counsel.
  • With respect to contingency or defensive litigation-related issues, assist with responses to requests for information, whether informal or by subpoena, Congressional inquiry, federal or state agencies, or state attorneys general.
  • Assist with overall management and strategic direction of the PhRMA amicus curiae program.
  • Provide legal, strategic, and policy advice and leadership, including counseling to senior management regarding current or future litigation matters that support the Board’s top policy priorities.
  • Prepare analytical memos, litigation, communication, and advocacy materials, and other documents.
  • Manage a strategic litigation work group of member company litigators including coordination with ongoing legal and policy advocacy activities.
  • Support General Counsel activity across PhRMA as required.
  • Provide general legal back-up for PhRMA activity (e.g., compliance monitoring at attended meetings).
  • Perform other duties as assigned.

Demonstrated consensus-building, decision-making, and interpersonal skills are essential. This is a highly visible, fast-paced position that is both internally and externally facing. Accordingly, the successful candidate should be adaptable, able to reprioritize and shift gears quickly, comfortable in a high-pressure environment, as well as politically savvy, diplomatic, responsive, and mature.

Professional Experience / Requirements

  • J.D. and Member of D.C. Bar.
  • Biopharmaceutical or healthcare litigation experience and expertise.
  • 9+ years of progressive experience as litigation counsel, preferably in the biopharmaceutical or healthcare industry.
  • Significant experience in developing litigation strategy is required.
  • Strong familiarity with federal court procedures including appellate court developments.
  • Experience with administrative law concepts and legal challenges to agency decision-making.
  • Experience in trade associations or as legal counsel for member companies.
  • Strong problem-solving, analytic, and writing skills.
  • Ability to manage multiple complex high-visibility priorities simultaneously.
  • Excellent communication skills with the ability to represent PhRMA at conferences/events.
  • Ability to communicate legal concepts and opinions to non-lawyers both verbally and in writing.
  • Ability to facilitate meetings with, work with, and drive consensus among disparate stakeholders.
  • Strong interpersonal and negotiating skills.

Preferred Experience / Requirements

  • Experience clerking for a federal court judge, working on Capitol Hill, at HHS, and/or state legislative or regulatory experience.

Potential Salary

$243,200 – $346,700 per annum. Salary is commensurate with experience and other compensable factors.
